Information about us

www.shopcade.com, the Shopcade application on Facebook, the Shopcade mobile applications, the Shopcade widget and associated websites are operated by Shopvolution Limited ("we, "us", "Shopvolution" or “Shopcade”), incorporated and registered in England and Wales. Our registered office is at 87 Notting Hill Gate London W11 3JZ, United Kingdom and our main trading address is 1st Floor (Rear/South Suite), 87 Notting Hill Gate, W11 3JZ London. Our VAT number is 112844730.

How our service works

To use and access our Service, you need to create an account either by connecting with your Facebook, Google or Twitter accounts or by creating an account on Shopcade directly with your email. This can be done via our website www.shopcade.com or by loading the Shopcade mobile application on your mobile device. Alternatively you can install the Shopcade application on your Facebook profile page ("Profile Page").

Once you do this, our Service works as follows:

Approved partner merchants ("Partner Merchants") make their products available to us and these are listed in our online catalogue ("the Products").

We actively monitor our online catalogue, and do our best to remove Restricted Products including, but not limited to, alcoholic products, products of adult nature, smoking products, weapon based products, certain categories of health products, medicines and medical devices, and weight control and slimming products ("Restricted Products"). This is done by a combination of automated filters and manual reviews. However, in the unlikely event that you should come across a Restricted Product, please report it to feedback@shopcade.com.

You can, subject to any age restrictions, find and “want” or "like" Products that you like, recommend them to your friends and other Shopcade users and get deals on these products.

When you create a Shopcade account, Shopcade automatically creates a page called “Your Profile”, also referred to as "Your Shopcade". On this page you can collect all the Products you love and organize them in Product Lists.

Whenever you “Want” a Product on Shopcade, this Product is automatically added to Your Shopcade. You can also add a Product to Your Shopcade from anywhere on the web, by using the Shopcade bookmarklet or the “Add a product” button on the site.

You can create Product Lists to organize the Products you have collected in Your Shopcade.

We may now or in the future permit you to write a small text in the “Describe what you’re into” box in Your Shopcade and a description for every Product List in Your Shopcade. You have the right to link back to an external website in these text boxes. We may moderate your text, we may amend or remove any content which we consider in contravention with our Terms of Service in general and our Content Standards in particular. If you think that you have been moderated in error, please contact feedback@shopcade.com.

We occasionally offer games, competitions and contests with prizes through our Service, these are detailed at the time of launch.

You also have the possibility to earn our virtual currency ("Points") by using the Service. You can find more information on how you can earn and use Points at Shopcade here.

Accessing our site or our service

You must be at least 13 years of age and capable in your country of residence of entering into legal binding agreement to use our Service. If you are under the age of majority, you represent that your parents or legal guardians have read and agreed to these Terms of Service.

You are responsible for maintaining the confidentiality of your login details and any activities that occur under your account. If you have any concerns about your login details or think they have been misused, you should contact us at privacy@shopcade.com straight away to let us know.

Acceptable use

You agree not to misuse or attempt to misuse the Service, and to use the Service only in a manner consistent with these Terms of Service. You may use our Service only for lawful purposes and you may not use our Service in any way that breaches any applicable local, national or international law or regulation (including, without limitation, laws governing intellectual property and other proprietary rights, and data protections and privacy) or to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards described below.

You also agree not to access without authority, interfere with, damage or disrupt any part of our Service or any network or equipment used in the provision of our Service.

You agree that you will not rent, lease, loan, sell, resell, sublicense, distribute or otherwise transfer your account or any of your rights granted by us under these Terms of Service.

You agree not to impersonate any person or entity, falsely claim an affiliation with any person or entity, access the accounts of others without permission, misrepresent the source, identity, or content of information transmitted via the Service, or perform any other similar fraudulent activity.

Fraud

Each user may not have more than one Shopcade account. If we suspect that an individual is using multiple accounts, including to artificially boost Points, Trend Score, or obtain any other form of advantage, we reserve the right to suspend their accounts at any time.

Deals

Shopcade regularly features deals on certain products.

Some of these deals can be revealed by clicking on the “Shop” link provided in the product description window. For each deal, please refer to the terms and conditions provided in the product description window. Clicking “Shop” will open the Partner Merchant’s site in a new tab and reveal the code in the product description window in Shopcade. Please note that we rely on the information provided to us by our Partner Merchants; in some instances, this information might not be complete and as a result, deals featured on certain products might not apply to these products. Shopvolution Ltd cannot be held responsible for such instances.

Other deals are unlocked by sharing the product with three friends by tagging them on Facebook, Twitter or email. These deals can be in the form of a voucher code (“Unlocked Voucher Codes”) or Cashback on your purchase (“Unlocked Cashback Deals”).

In the case of Unlocked Voucher Codes, the code will be revealed in a new window (and in a new notification) as soon as you have shared it with three friends.

In the case of Unlocked Cashback Deals, the amount of Cashback you will receive will be based on the actual purchase price before any tax, shipping and handling costs. Please note the Cashback amount might be lower than advertised for this product on Shopcade, for example on sale/ clearance items or when applying a voucher code. The Cashback amount might also be higher than advertised if you purchase other items as part of the same transaction. In certain cases, transactions carried on mobile will not be eligible for Cashback.

Some “Exclusive Cashback Deals” may be accessible without unlocking, but will only be valid with minimum purchase amount, as indicated on the deal banner.

In the case of Cashback on your purchase, this will be credited into your Shopcade account after the purchase, provided you click on the “Shop” button on the product page of the product you unlocked Cashback on (see the Help page for more details) in the case of Unlocked Cashback Deals or on the "Shop" button on the product page of a product with a valid Exclusive Cashback Deal banner.

We use cookies to track purchases so please note that your purchase will not qualify for Cashback if you visit any other affiliated, partner or third party website after clicking on the Shopcade “Shop” button or if you delete or disable cookies prior to or during the purchase.

We will credit your Cashback to your Shopcade account as soon as we receive confirmation of the Sale from the Partner Merchant. This may take several days.

You recognize that we are wholly reliant on our Partner Merchants for the tracking of purchases made through our Service, and are therefore reliant on our Partner Merchants reporting to us any Purchase. Therefore, we are not responsible and do not accept any liability for any failure, error or omission on part of the Partner Merchant in recognizing or reporting to us a Purchase or paying any sums to us in respect of the Cashback.

If you believe that you are entitled to Cashback but have not received any Cashback notification more than 5 days after your purchase, or if you believe that an incorrect amount of Cashback has been credited to your account, you may make a claim for such Cashback by sending an email to cashnotifications@shopcade.com. Any claim you make must specify in detail why you consider that Cashback is due to you and provide evidence of your purchase (confirmation email from Partner Merchant). If you do not provide this, we will not be able to consider your claim although we will tell you this. We will review such claim and, where we determine that an error has been made, we will credit your Shopcade account with the correct amount of Cashback, provided that we have received any fee due to us from the Partner Merchant in respect of such Cashback.

In the case of Unlocked Cashback, you will not be able to access your Cashback right away after it has been credited on your Shopcade account. Your Cashback will become accessible to you only when we receive our fee from the Partner Merchant in respect of the Sale (which may take several weeks). Your Cashback will only become accessible once we are sure that the Partner Merchant cannot ask for a refund as a result of a cancellation of the Sale by the purchaser. In the event that we are required to make a refund to the Partner Merchant and the Cashback has already been credited to your Shopcade account, we will make a debit to your account to reflect any Cashback refunded to the Partner Merchant.

In the case of Exclusive Cashback and only in this case, your Cashback will be accessible immediately after it has been credited on your Shopcade account.

Once confirmed, Cashback can be:

- Converted into Shopcade points; or

- Donated to one of our approved charities; or

- If you are at least 18 years old and provide an email address, transferred to your PayPal account. A 0.5% processing fee may be deducted by Paypal for every transfer to your PayPal account and a minimum amount may apply for paypal transfers and donations.

Unlocked Cashback Deals are valid for 30 days only after being unlocked.

Exclusive Cashback Deals are valid as indicated on the deal banner.

We have no liability for hacking or loss of your Cashback. We have no obligation to, and will not, reimburse you for any Cashback that is lost due to your violation of these Terms. We reserve the right, without prior notification, to limit the quantity of Cashback and/or to refuse to provide you with any Cashback. Amount, exchangeability, eligibility and availability of Cashback are determined by us in our sole discretion and are subject to change without notice. You agree that we have the absolute right to manage, distribute, regulate, exchange, control, modify and/or eliminate Cashback as we see fit in our sole discretion, and that we will have no liability for exercising such right. You agree that under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your Cashback regardless of the circumstances. You absolve us of any responsibility to maintain or update your Cashback account. However, if there is a loss of Cashback in your account due to technical or operational problems with the Service, we will refund the lost Cashback once the loss and cause have been verified. Without limiting any of the foregoing, our maximum liability or responsibility to you is to refund the lost.

Shopcade "Points" virtual currency

The Service may include an opportunity for you to earn (including by completing actions or activities), buy or use a type or types of points or virtual currency ("Points") including, but not limited to so-called Shopcade Points, coins, or virtual cash, to take part in contests, sweepstakes and missions, play games, download Shopcade or third-party applications, license virtual digital goods or items, establish reputation, or obtain discounts, offers or other goods or services (together "Rewards").

Regardless of what we call them, Points are not real money, do not have monetary value, and may never be redeemed for "real world" money, or other items of monetary value from outside of the Services without our written permission. While we may use terms like "buy", "purchase" or "sell" in reference to the Points, we do so only for convenience and such terms in no way indicate that Points has monetary value or is real money. You acknowledge that Points are not real currency and are not redeemable for any sum of money from us at any time. We make no guarantee as to the nature, quality or value of the features of the Service or any third-party good or services that will be accessible through the use of Points, or the availability or supply of Points.

Points obtained via the Service are provided to you under a limited, personal, revocable, non-transferable, non-sublicenseable license to use within the Service. Points may not be transferred or resold in any manner, including, without limitation, by means of any direct sale or auction service. You have no property interest, right or title in or to any such Points appearing or originating in the Service, or any other attributes associated with use of the Service. Any "virtual currency" balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license.

All Points and Rewards are forfeited if your account or access to the Services is terminated or suspended for any reason, in our sole and absolute discretion, or if we discontinue availability of some or all of the Service. We may at any time expire free or promotional Points given to you.

We have no liability for hacking or loss of your Points or Rewards or any goods or services obtained via Points. We have no obligation to, and will not, reimburse you for any Points or Rewards or any goods or services obtained via Points that are lost due to your violation of these Terms. We reserve the right, without prior notification, to limit the quantity of Points and/or Rewards and/or to refuse to provide you with any Points and/or Rewards. Price, exchangeability and availability of Points and Rewards are determined by us in our sole discretion and are subject to change without notice. You agree that we have the absolute right to manage, distribute, regulate, control, modify and/or eliminate Points as we see fit in our sole discretion, and that we will have no liability for exercising such right. You agree that under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your Points regardless of the circumstances. You absolve us of any responsibility to maintain or update your Points account. However, if there is a loss of Points in your account due to technical or operational problems with the Service, we will refund the lost Points once the loss and cause have been verified. Without limiting any of the foregoing, our maximum liability or responsibility to you is to refund the Points lost.

Trend Score

Your influence on the community is measured through a Trend Score. This score measures your reach and your ability to start trends. This is measured by tracking activity from various types of internal actions (within our Service) and external actions (from other Internet-based sources).

Examples of internal actions which can increase your Trend Score include, but are not limited to, when you look at someone else’s ”Shopcade” or list within that ”Shopcade”, view or add products from the products catalogue, create a new list, or when other users view or add products you added, when other users visit “Your Shopcade”, follow “Your Shopcade” or promote the product through social media (e.g., Facebook® “like” a Shopcade/list). Successfully inviting friends to subscribe can also increase your Trend Score.

Examples of external actions which can also increase your Trend Score include, but are not limited to, the number of friends you have on social media sites (e.g., Facebook®), your interactions on social media sites (e.g., “likes” received, comments on “wall,” and so on), the number of your followers on Twitter®, your interactions on Twitter® (e.g., retweets, favourites, direct messages, and so on), your activity and engagement on other relevant social platforms such as Pinterest®, Youtube® and others.

In the complex Trend Score calculation, the more recent the action, the more weight it has on the total Trend Score. For example, an action that occurred today is more valuable compared to an action that occurred one month ago. The Trend Score of an inactive user will decrease over time.

Reaching a certain level of Trend Score can enable you to unlock certain Rewards.

Rewards and Redemption of Shopcade "Points"

You may from time to time be presented with opportunities to redeem Points for Rewards. We will, in our sole discretion, determine and communicate the availability and exchange rate for any Points and Rewards, which may be modified at any time. You must comply with any individual Rewards limitations as indicated via the Service (or partner's terms or website). We reserve the right to cancel, restrict or terminate Points and/or Rewards at any time for any reason. All Rewards are subject to availability. Some Rewards will be actual products. In the case of the product being unavailable at the time of redemption, you will be offered the possibility to receive a similar product or a voucher code of the closest relative value or get a refund of your points. All redemptions are subject to these Terms of Service, any third-party terms associated with a specific Reward, and all limitations and requirements stated via the Services.

You may choose a Reward that is still available for which you have accumulated sufficient Points and have reached the necessary Trend Score for redemption. Select the Reward you wish to use and follow the instructions to complete the redemption process. As part of the redemption process, you may receive a confirmation email or message from us and/or our Rewards partner and, when applicable, an email or message containing the Rewards in the form of a link, code, coupon or similar means. Emails or messages will be sent to the email address or other contact information assigned to your account. For Rewards that require delivery, in most cases you should expect delivery within 6 (six) weeks of the redemption date. Each Reward can only be redeemed once per user. All acquisitions of Points and redemptions for Rewards are final. Once Points have been lost or spent, they will be subtracted from your account and cannot be refunded or returned, except in our sole discretion. No Points will be re-credited to your account in the event of a return or exchange of a Reward, or any problem with any Reward.

You may from time to time be offered a mystery reward ("Mystery Reward"). This mystery perk can be, with equal probabilities:

• A trend score boost between 1 and 10

• Shopcade points, between 100 and 500 (in 100 increments)

• Entries into one of our Sweepstakes, between 1 and 10

Occasionally this mystery reward can be a combination of the various options. When offered by email, this Mystery Reward may be redeemed by clicking on the link provided in the email and login into our Service.

SHOPCADE MISSIONS

Shopcade may organize several types of missions that users can play, including but not limited to:

  • Missions to enter sweepstakes (“Sweepstake missions”); this includes, but is not limited to, Superdraw Missions and Sweepstakes Missions sponsored by Partner Merchants;

  • Missions to unlock vouchers from our partner merchants (“Voucher missions”);

  • Missions to win specific rewards by making purchases via Shopcade (“Shop and Win missions”);

  • Missions to win specific rewards by playing games (“Games missions”);

  • Missions to win specific rewards by inviting people to join Shopcade ("Invite & Win" or "Member get Member" missions);

  • Missions to win specific rewards by attracting the most votes ("Votes Missions");

  • Missions to win specific rewards for the best entry as evaluated by a jury ("Best-Entry-Wins Missions").

ELIGIBILITY

  • To be eligible to win a mission, you need to be a registered user on Shopcade and legal resident of the Continental U.S., (excluding Rhode Island and where prohibited by US federal, state and local law) or the United Kingdom at the time of entry, except employees of Shopvolution Limited, their respective subsidiaries, advertising and promotional agencies and affiliates.
  • The missions are open only to persons aged 18 years or older at the time of entry, unless they have parental consent. Void where prohibited by law.
  • Oher eligibility requirements are as specified under each mission type.
  • By entering a Shopcade Mission, entrants confirm that they meet all eligibility requirements.
  • SWEEPSTAKE MISSIONS

    NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. A PAYMENT OR PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING.

      Sweepstake Missions Sponsor and Administrator

The Sweepstake Mission will be live on the dates indicated on each specific Sweepstake Mission description posted on one of the above channels. To enter the Sweepstake Mission, perform the actions specified on the Sweepstake Mission description. These actions may include, but are not limited to: Follow a brand on Shopcade, Share the Mission on Facebook, Follow @shopcade on Twitter, Tweet or retweet the mission on Twitter (possibly with specific hashtags such as, but not limited to, #FreebieFriday), Follow Shopcade on Instagram, Tag on an Instagram picture @Shopcade (possibly with specific hashtags such as, but not limited to, #FreebieFriday, #ShopcadeStyle, #GameOn), Spend Shopcade points, Invite Friends on Shopcade, Create a List in Your Shopcade, Shop a Brand or Partner Merchant via Shopcade.
    4. US residents only: To enter the Competition by email, you may send an email containing your name, address, city, state, zip code and telephone number and titled “Sweepstake Mission [name]” to competition@shopcade.com.
    5. Who is Eligible?

    7. No entries will qualify if received before the Start Date or after the End Date.
    8. Prizes are non-transferable, although they may be substituted by the Sponsor in its sole discretion, including in the event that a desired prize is not available.
    9. By entering the Sweepstake Mission, entrants confirm that they meet all eligibility requirements.
    10. Sweepstake Missions Prize(s) and How Winners will be Determined

    11. The winner(s) will receive the prize(s) specified on the Sweepstake Mission description.
    12. The winner(s) will be randomly selected from all eligible entries received between the Start Date and the End Date. Shopcade may change the start and end dates at its sole discretion.
    13. The odds of winning the Sweepstakes Missions will be dependent on the total number of eligible entries received. Entry is free. No purchase is necessary. If entrants entered the Sweepstake Mission by sending an email as described above, the Sponsor will assume that they have the average number of entries per entrant at the time of the draw.
    14. Mechanically reproduced entries will not be accepted. Incorrect, illegible, and incomplete entries are void.
    15. The winner(s) may be featured in Shopcade’s newsletter, blog, Facebook page or any other promotion channel.
    16. We will notify the winner(s) by email, or via the relevant channel where email is not available, within five (5) days of the Sweepstake Mission End Date as indicated on the Mission description. The winner(s) will be required to provide their contact details for the delivery of the prize. Failure to respond to this email within seven (7) days will result in forfeiture of the prize.
    17. One Direction competition (#SHOPCADE1D): for this specific Sweepstake Mission only, the winner(s) will be required to respond to the notification email within four (4) hours. Failure to respond to this email within four (4) hours will result in forfeiture of the prize.
    18. To request a list of winners of a Sweepstake Mission, send a request to: Shopvolution Limited, Sweepstake Winner’s Request List, First floor, 87 Notting Hill Gate, London W11 3JZ, United Kingdom.
    19. US residents only: If a winner does not have a Shopcade account and he or she entered the Sweepstake by sending an email in accordance with these Official Rules, he or she will have to log in to Shopcade to receive the prize(s).
    20. By entering the Sweepstake Mission, all entrants consent to the use of their name, photograph, or likeness for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law.
    21. All costs, taxes, fees, and expenses associated with any prize shall be the sole responsibility of the prize winners. The payment and reporting of any applicable federal, state and local taxes are the sole responsibility of the prize winners.
    22. We reserve in all cases the right to replace the stated prizes with other prizes that we consider to be of broadly equivalent value. We offer no cash alternative for non-cash prizes, and prize winners must accept prizes in the form offered. Prizes are not refundable or transferable.
    23. General

    24. You should read these Terms in conjunction with the Shopcade Privacy Policy and Shopcade Terms of Service as these will also apply to the Sweepstake Missions. In particular, please refer to the Missions Disclaimer, Missions Sponsor's Rights and Missions Limitations of Liability.
    25. Acceptance of these Terms is a condition of entry for the Sweepstake Missions. By entering the Sweepstake Missions, the entrant agrees to be bound by these Terms and the decisions of the Sponsor which are final and binding in all respects. You may want to print these Terms for future reference.

    VOUCHER MISSIONS

      Description of the Voucher Missions and How to Enter

    1. Voucher Missions are featured on Shopcade's landing page or in 'Your Feed' page. The Voucher Missions will be live on the dates indicated on the Voucher Missions pop-up.
    2. To unlock the voucher code, complete the Voucher Mission by performing the actions specified on the Mission pop-up. These actions may include, but are not limited to: Follow a brand on Shopcade, Share the Mission on Facebook, Tweet the Mission on Twitter, spend Shopcade points, Invite Friends on Shopcade.
    3. When a user has completed the Mission, the voucher code associated with the Mission will be displayed on the Mission pop-up. Users will also receive a Shopcade notification and may receive an email containing the voucher code.
    4. Entry is free. No purchase is necessary.
    5. Who is Eligible?

    6. You need to be a registered user on Shopcade and legal resident of the Continental U.S., (excluding Rhode Island and where prohibited by US federal, state and local law) or the United Kingdom at the time of entry, except employees of Shopvolution Limited, their respective subsidiaries, advertising and promotional agencies and affiliates. The missions are open only to persons aged 18 years or older at the time of entry, unless they have parental consent. Void where prohibited by law.
    7. The payment and reporting of any applicable federal, state and local taxes are the sole responsibility of the entrants.

    SHOP & WIN MISSIONS

    On a regular basis, Shopcade will award specific rewards, such as bonus Shopcade points, to users for making purchases via Shopcade. Reward and purchase requirement will be specified in a tile promoted in the user's Following feed.

    Purchases requirement may include, but are not limited to: purchasing from a list hosted on Shopcade’s Shopcade, purchasing above a certain minimum, purchasing from the entire Shopcade catalogue, purchasing a product, purchasing from a specific retailer or brand, purchasing from a deal.

    These missions will be live on the dates indicated in the tile promoted in the user's Following feed.

    The reward will be awarded to the user within 7 days of Shopcade receiving confirmation of the purchase from the merchant. We reserve the right to withhold the reward if the purchase is later cancelled. In some instances, purchases might not be tracked correctly by merchants and affiliation platforms - in these situation's Shopcade will not be held responsible for not awarding the reward to users.

    GAMES MISSIONS

    Shopcade may offer users the possibility to play games such as, but not limited to, matching friends with products they might, testing their knowledge of brands, merchants, themes. Shopcade may reward top players as specified in the Game Mission pop-up.

    INVITE & WIN (MEMBER GET MEMBER) MISSIONS

    NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. A PAYMENT OR PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING.

      Invite & Win Sponsor and Administrator

    1. The Invite & Win Sponsor and Administrator is Shopvolution Limited, 87 Notting Hill Gate, London W11 3JZ, United Kingdom (“Sponsor”).
    2. Description of the Invite & Win Missions and How to Enter

    3. Invite & Win Missions are featured on Shopcade's Invite page. The Invite & Win Missions will be live while they appear on the Invite page. You can play the Invite & Win Missions by inviting friends to join Shopcade. Valid methods of invitation may include, but are not limited to: Post the Invite & Win invitation on Facebook (as a message to a friend, or on your timeline), Tweet the invitation to your followers on Twitter, and other methods of invitation to Shopcade, via Shopcade invite mechanisms, including inviting people to join Shopcade via other missions.

    14. A valid invitation method is defined as one of several invitation methods available via Shopcade (such as all methods on shopcade.com/invite, as well as other methods of invitation via Shopcade’s sharing mechanisms).
    15. A valid invitation message is defined as an invitation to Shopcade that is not based solely on the prospect of winning a prize, and should not be misleading.
    16. Each successful invitation will be confirmed as valid or not by Shopcade.
    17. What Constitutes an Invalid Entry

Invalid entries include those made via voting exchanges (such as websites and Facebook pages in which members help increase votes and entries in order to help another member win or earn a prize or other benefit, for the sole purpose of receiving the benefit) and other similar services, sites, blogs and pages. Entries from these and similar sources will not be accepted, unless prior approval has been given by Shopcade.     21. Invalid entries may also include any entries that are automatically flagged.   • SHOPCADE WIDGET

    We may now or in the future permit you to insert a Shopcade Widget (“Widget”) in your own webpage.

    In order to create and install the widget, you need to have or create a Shopcade account. By doing so and by using our Service, you indicate that you accept these Terms of Service and that you agree to abide by them. If you do not agree to these Terms of Service, please do not use our Service.

    There are currently two types of widgets.

    The first type of widget enables you to display, on your webpage, one of the lists you created in your Shopcade (“list widget”). The content of the widget will reflect the content of the list, meaning that changes made to the list in Shopcade will be visible in the widget without the need to edit the widget.

    The second type of widget will scan the content of your webpage, identify keywords and match these with relevant trending products from the Shopcade catalogue, and display these products on your webpage (“contextual widget”). Products will be displayed based on the highest relevancy and popularity among Shopcade users based on a proprietary algorithm. At present, the contextual widget will only return relevant products on webpages with English language content.

    Readers of your webpage will be able to click on the products displayed in the Shopcade widget to be redirected to the related merchant site to purchase the product. If the Merchant is a Partner Merchant having agreed to pay a commission on sales referred through Shopcade service, where a reader of your webpage purchases this Product (and/or any other product) from such a Partner Merchant as a result of a direct referral through your Shopcade widget (a "Sale"), you may be entitled to receive Earnings. Your Earnings will be 75% of the commission paid to us by the Partner Merchant in relation to the Sale. Some products do not trigger any commission.

    You recognize that we are wholly reliant on our Partner Merchants for the tracking of purchases made through our Service, and are therefore reliant on our Partner Merchants reporting to us any Purchase and paying us any commission. Therefore, we are not responsible and do not accept any liability for any failure, error or omission on part of the Partner Merchant in recognizing or reporting to us a Purchase or paying any sums to us in respect of these Earnings.

    If you believe that you are entitled to Earnings but have not received any Earnings notification more than 5 days after a purchase, you may make a claim for such Earnings by sending an email to cashnotifications@shopcade.com. Any claim you make must specify in detail why you consider that Earnings are due to you and provide evidence of the purchase (confirmation email received by the buyer from Partner Merchant). If you do not provide this, we will not be able to consider your claim although we will tell you this. We will review such claim and, where we determine that an error has been made, we will credit your Shopcade account with the Earnings amount, provided that we have received any fee due to us from the Partner Merchant in respect of such Earnings.

    We will credit the Earnings to your Shopcade account when we receive confirmation of the Sale from the Partner Merchant (which may take several days). These Earnings will appear in Your Cashback section. However, you will not be able to access these earnings right away. Your earnings will become accessible to you only when we receive our fee from the Partner Merchant in respect of the Sale (which may take several weeks). Your earnings will only become accessible once we are sure that the Partner Merchant cannot ask for a refund as a result of a cancellation of the Sale by the purchaser. In the event that we are required to make a refund to the Partner Merchant and the Earnings have already been credited to your Shopcade account, we will make a debit to your account to reflect any Earnings refunded to the Partner Merchant.

    We will provide periodic reports giving you statistical information related to traffic and sales generated by your Shopcade widget. These will be sent to the email linked to your Shopcade account. You can edit this email in Your settings section.

    Once confirmed, Earnings can be:

    - Converted into Shopcade points; or

    - Donated to one of our approved charities; or

    - If you are at least 18 years old and provide an email address, transferred to your PayPal account. A 0.5% processing fee may be deducted by Paypal for every transfer to your PayPal account and a minimum amount may apply for paypal transfers and donations.

    The widget is free to install. It includes a ‘Shopcade’ logo which you agree to display by installing the widget.

    We hereby grant you a limited, non-transferable, non-sublicensable, non-exclusive license to display the Shopcade widget and advertise your use of Shopcade service, subject to the limitations described in these Terms of Service, including, but not limited to, the following:

    Neither you nor we own the Merchant content. You may use Merchant content only through the Shopcade widget and you may not alter its form, format, appearance or overall presentation from the way it appears through the Shopcade widget. You are not allowed to reproduce, distribute, modify, display or otherwise use the Merchant content, except as it appears through the Shopcade widget.

    You may display the Shopcade widget on your site provided the Content of your site complies with our Content Standards and Community Guidelines. You are not allowed to temper with the Shopcade widget in any way, such as, but not limited to, removing our links or logo. If we believe that you are not complying with these Terms and Conditions or tempering with the widget, we reserve the right to disable your access to the widget.

    Your contributions

    We may now or in the future permit you to post, upload, transmit or otherwise provide through our Site or Service messages, text, illustrations, files, images, graphics, photos, comments, sounds, music, videos, information (e.g., your name, e-mail address, etc.) and other content (collectively "Contributions"). For example, any comment, rating or review of a Product or a Partner Merchant that you post on our Site or upload using our Service is your Contribution. Similarly, the description of Your Shopcade, the names of the lists you create in Your Shopcade and their descriptions are also your Contributions.

    We may from time to time provide certain features, which allow you to interact on our Site or through our Service such as chat rooms and other non-instantaneous methods of communication including, but not limited to, ratings, comments and reviews.

    We may moderate your Contributions, we may amend or remove any content which we consider in contravention of Terms of Service as set out in the Content Standards paragraph below. If you think that you have been moderated in error, please contact feedback@shopcade.com.

    We do not claim any ownership in your Contributions. However, you acknowledge and agree that we have the right to use, copy, distribute and generally exploit your Contributions to provide our Service and for any purpose related to our business and you grant us a perpetual, irrevocable, transferable, royalty-free license to do this.

    Content standards

    These content standards apply to any and all Contributions, and to any interactive services associated with it.

    You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any Contributions as well as to its whole.

    Contributions must be accurate (where they state facts), be genuinely held (where they state opinions) and comply with applicable law in the UK, USA and in any country from which they are posted.

    Your use of our Service and any Contributions must not:

  • contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory, promote sexually explicit material or promote violence or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

  • immediate, temporary or permanent removal of any Contribution uploaded by you to our Site or Service;

  • legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

    Each user may not have more than one Shopcade account. If we suspect that an individual is using multiple accounts, including to artificially boost Points, Trend Score, or obtain any other form of advantage, we reserve the right to suspend their accounts at any time.

    INACTIVITY

    If you do not use our Service or login to your account for a period of 12 months, we may close your account. We will contact you by email at least three times prior to closing your account to inform you that your account is due to be closed by reason of your inactivity.

    If we close your account for any reason, you will lose any balance shown in your Shopcade account.

    Intellectual property rights

    Our Site, Service and related content (and any derivative works or enhancements of the same) including, but not limited to, Product information, text, illustrations, files, images, software, scripts, graphics, photos, sounds, music, videos, information, content, materials, products, services, URLs, technology, documentation and interactive features (the "Content") and all intellectual property rights to the same (excluding Contributions) are owned by us, our licensors, or both.

    The Site, Service and related content are protected by applicable copyright and trademark laws and various other intellectual property rights and unfair competition laws and treaties around the world. All such rights are reserved.

    6. Thou shall report anything you’re weary of If you’re unsure about something on Shopcade feel free to flag it (quite literally - we have a flag ;)) to our team on our Community Forum, we’ll be sure to get back to you asap.

    7. Thou shall not restrict yourself Yep, we now have private messaging on Shopcade so you can PM your friends - don’t just limit yourself to this though! Comment on lists and share stuff you love just by tagging others. (Just use their username @insertnamehere to tag)

    8. Thou shall not be insulting It’s just not cool, guys. Shopcade’s about having fun! Let’s keep the nastiness at bay and concentrate on having a good time.

    9. Thou shall stay safe This means being smart and not posting your personal details on the site (personal details include: email addresses, bank details, home addresses, or phone numbers). You wouldn’t write your passwords on your forehead and walk around like that, so why do it online? :)

    10. Thou shall respect copyright and confidential property Passing off something as your own when it really isn’t is just plain weird. Don’t use anyone else’s photos, text or videos as your own, they’ve put effort into creating those! If you do feel inspired then please be sure to credit the content owner in the blurb.

    For the Third Style Battle only, the photo must be a full length festival look. Other types of looks will not qualify

    You are allowed to enter several times in this Style Battle.

    Who is Eligible?

    You need to be a registered user on Shopcade and legal resident of the United Kingdom at the time of entry, except employees of Shopvolution Limited, their respective subsidiaries, advertising and promotional agencies and affiliates. Void where prohibited by law.

    No entries will qualify if received before the Start Date or after the End Date.

    Prizes are non-transferable, although they may be substituted by the Sponsor in its sole discretion.

The participant will be requested to prove that the photos are indeed theirs and that they are over the age of 18, unless they have a written permission from a parent or legal guardian. Finalists and winners will be notified on July 4th 2014 via email.

    Fourth Style Battle Prize and dates: The winners will be given a complete professional fashion photo shoot experience. The resulting photos will be featured on Shopcade mobile fashion app, on WEARECOLLISION magazine and may be featured in other publications, sites, apps. The winners will also get gift bags including pieces from Villain and FYT & CO. Starting on July 25th 2014, Shopcade will begin emailing select participants for extra details - these emails must be responded within 2 days for the participant to qualify as a potential finalist. The participant will be requested to prove that the photos are indeed theirs and that they are over the age of 18, unless they have a written permission from a parent or legal guardian. Finalists and winners will be notified on August 1st 2014 via email.

    The Sponsor may change the start and end dates of the Style Battle at its sole discretion.

    The winning users will be determined by The Sponsor. The winners must meet all the eligibility requirements for the Style Battle as described above. The Sponsor will determine whether the winners meet those requirements. Winners who do not meet the eligibility requirements for the Style Battle will be disqualified and alternate winners may be selected. All decisions of the judges regarding this Style Battle are final and binding in all respects. Style Battle is void where prohibited. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

    The Sweepstakes will run from 31th March 2014 12:00am GMT to 12th May 2014 12:00am GMT (the "Entry Period").

    To enter the Sweepstakes, you must be a registered user of Shopcade mobile fashion app (on iOS or Android mobile devices) and you need to upload your “Look” using the Shopcade mobile fashion app, and tag it using the #getpacking hashtag. Your also need to share your Look on Instagram, Facebook and/or Twitter in order to be eligible. The Look you upload will also need to be based on the theme featured on Shopcade’s blog and described here:

    • Week 1: March 31st 2014 - April 6th 2014 - Theme for look: Thrillseekers.
    • Week 2: April 7th 2014 - April 13th 2014 - Theme for look: Festival Lover.
    • Week 3: April 14th 2014 -April 20th 2014 - Theme for look: Wanderingstyle.
    • Week 4: April 21st 2014 - April 27th 2014 - Theme for look: Globetrotter.
    • Week 5: April 28th 2014 - May 4th 2014 - Theme for look: Sailaway.
    • Week 6: May 5th 2014 -May 11th 2014 - Theme for look: Chic camping.

    Each look uploaded will count as one entry, provided it is properly hashtagged, shared and based on the theme, and you are allowed to enter several times.

    Who is Eligible?

    You need to be a registered user on Shopcade and legal resident of the Continental U.S., (excluding Rhode Island and where prohibited by US federal, state and local law) or the United Kingdom at the time of entry, except employees of Shopvolution Limited, their respective subsidiaries, advertising and promotional agencies and affiliates. The SHOPCADE / CONTIKI Sweepstakes (“Sweepstakes”) is open only to persons aged 18 years or older at the time of entry, unless they have parental consent. Entrants must be aged between 18 and 35 at time the winner is chosen in order to travel with Contiki. Void where prohibited by law. Employees, officers, principles, directors or agents of Shopvolution Limited (the “Sponsor”), Contiki U.S. Holdings, Inc. (“Contiki”), and their respective subsidiaries or affiliates, and members of their households or immediate families, are not eligible to participate.

    No entries will qualify if received before the Start Date or after the End Date.

    Prizes are non-transferable, although they may be substituted by the Sponsor in its sole discretion.

    By entering the Sweepstakes, entrants confirm that they meet all eligibility requirements.

    Any violation of the Official Rules may result in disqualification. The Sponsor has no obligation to notify violators of their disqualification.

    Sweepstakes Prizes and How Winners will be Determined

    Each week a winner will be randomly selected from all eligible entries received during that week as per the description below. Each entry will serve as a Sweepstakes entry for the weekly prize as well as for the final grand prize.

    We will notify the winners by email, on or about the dates indicated for each prize. The winners will be required to provide their contact details for the delivery of the prize. Failure to respond to this email within seven (7) days will result in forfeiture of the prize.

    The winners will be required to prove eligibility to receive and claim any prize. All decisions of Shopcade and Contiki about the winners are final, binding and non-appealable. Shopcade and Contiki are not responsible for any incorrect or illegible address information or the non-delivery of any prize resulting there from, or for any unsuccessful efforts to notify a winner. It is the sole responsibility of the entrant to notify Shopcade/Contiki by mail if the entrant changes his/her email address. (To do so, send notification to winners@shopcade.com). In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized accountholder of the e-mail account.

    • Week 6: May 5th 2014 -May 11th 2014 – Grand Prize: Contiki Mexico Trip, see further details below. Winner selected from all valid entries received during the entire Entry Period (March 31st 2014 to May 11th 2014) and notified on May 12th 2014.

    Shopcade may change the start and end dates at its sole discretion.

    The odds of winning the Sweepstakes will be dependent on the total number of eligible entries received. Entry is free. No purchase is necessary.

    By entering the Sweepstakes, all entrants consent to the use of their name, photograph, or likeness for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law.

    All costs, taxes, fees, and expenses associated with any prize shall be the sole responsibility of the prize winners. The payment and reporting of any applicable federal, state and local taxes are the sole responsibility of the prize winners.

    We reserve in all cases the right to replace the stated prizes with other prizes that we consider to be of broadly equivalent value. We offer no cash alternative for non-cash prizes, and prize winners must accept prizes in the form offered. Prizes are not refundable or transferable.

    Grand Prize Description

    One (1) winner of the Grand Prize will be chosen at random from all eligible entries received during the Entry Period. The winner will receive one (1) tour for one (1) passenger on the following Contiki trip: Yucatan Highlights.

    What’s included: (i) airfare credit of USD1500 / GBP900 for use on airfare from the major gateway nearest winners’ home to Mexico City and departing Cancun back to the major gateway nearest winners’ home, (ii) five (5) nights twin-share accommodations, (iii) five (5) continental breakfasts, (iv) three (3) dinners, as per itinerary (ARV USD1,275 / GBP855 per person excluding airfare credit).

    Winner must be 18 to 35 years of age at the time of travel. The winner will be solely responsible for his/her own transportation to and from winner’s home airport. Winner will also be responsible for all other expenditures not specifically mentioned on www.contiki.com (“Booking Conditions”) including, without limitation, airport taxes, airport transfers, passport and visa fees, insurance, laundry, phone calls, optional excursions, beverages, meals not detailed in the itinerary, special needs and services required by handicapped clients (see 5.3 under Vacation Details & Conditions), tips to tour managers, representatives, drivers and local guides, items of a personal nature, and excess baggage. Travel must take place by 31st December 2014. The Grand Prize is subject to availability and blackout dates, which may include major U.S. or U.K. holidays and other dates. Cancellation fees apply as outlined at http://www.contiki.com/booking-conditions. Contiki has the ultimate discretion in the scheduling of the Grand Prize trip. Grand Prize winner is responsible for 1) all travel documents including, without limitation, a current, valid passport or other travel documents acceptable to the airlines, the destination countries, Transportation Security Administration, and the US Government, as they apply, (2) all medical requirements, (3) respecting all local regulations and (4) for full compliance with the regulations of all venues. The Grand Prize has an approximate retail value of USD1,275 / GBP855 (excluding airfare) depending on date of travel. Should the value of the Grand prize be less than the ARV, the difference will not be awarded in cash or in kind. The Grand Prize is non-transferable and has no cash value.     Limits of Liability

    Entrant acknowledges and agrees that Shopcade and Contiki have no responsibility whatsoever for injuries, losses, or damages of any kind that result from entrance into the Sweepstakes or receipt, acceptance, possession, or use of any prize. Shopcade and Contiki assume no liability for lost or misdirected entry forms regardless of the circumstances.

    Shopcade maintains no control over the personnel, equipment, or operation of any air, water or surface carrier, ship line, bus or limousine company, transportation company, hotel, restaurant, or other person or entity furnishing service, products, or accommodations as a part of the prize packages including, without limitation, Contiki. Shopcade shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (1) by wrongful, negligent, or unauthorized act or omission on the part of Contiki or any of their agents, servants, employees, or independent contractors, (2) by any defect in or failure of any vehicle, equipment, instrumentality, service, product, or accommodation that is owned, operated, furnished, or otherwise used by Contiki, (3) by the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of Shopvolution Limited or (4) by any cause, condition, or event whatsoever beyond the control of Shopcade.

    Contiki maintains no control over the personnel, equipment, or products as a part of the prize packages including, without limitation, Shopcade. Contiki shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (1) by wrongful, negligent, or unauthorized act or omission on the part of Shopcade or any of their agents, servants, employees, or independent contractors, (2) by any defect in or failure of any equipment, instrumentality, service, or product, that is owned, operated, furnished, or otherwise used by Shopcade (3) by the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of Contiki or (4) by any cause, condition, or event whatsoever beyond the control of Contiki.

    Shopcade and Contiki reserve the right to cancel the Sweepstakes at any time if the integrity of the Sweepstakes is, in Shopcade’s or Contiki’s sole and absolute discretion, compromised in any way. By entering the Sweepstakes, entrants release and hold Shopcade and Contiki harmless from and against any and all damages and claims of any kind in connection with the Sweepstakes or resulting from entrance in the Sweepstakes, or receipt, acceptance, possession or use of any prize. Shopcade and Contiki reserve the right to substitute a prize for an alternative prize of equal or greater value in Shopcade’s and Contiki’s sole and absolute discretion.

Shopcade and Contiki reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes should cause beyond the reasonable control of Shopcade and Contiki corrupt the security or proper administration of the Sweepstakes. Any attempt to deliberately damage the legitimate operation of this Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Shopcade and Contiki reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

    Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California, County of Orange.     Winners are solely responsible for the reporting and payment of any tax liabilities incurred as a result of or relating to the awarding or use of any prize.     No liability shall be accepted for any occurrences resulting from the entrant’s connection to the Internet via Shopcade mobile app. The Sponsor does not accept liability for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which are stored on them, or to their personal, professional or commercial activities.

    This Sweepstakes will be governed by the laws of England and Wales. Any dispute or difference arising out of or in connection with this contract shall be determined by the appointment of a single arbitrator to be agreed between the parties, or failing agreement within fourteen days, after either party has given to the other a written request to concur in the appointment of an arbitrator, by an arbitrator to be appointed by the President or a Vice President of the Chartered Institute of Arbitrators.
